Jaime King Files Emergency Request for Spousal and Child Support to Be Changed

Jaime King has filed an emergency request to change the spousal and child support agreement she previously made with ex-husband Kyle Newman.

The court documents filed in Los Angeles County Superior Court — and obtained by PEOPLE on April 15 — indicate the Hart of Dixie alum, 44, “lacks the ability to pay the support” and is asking for the court to end the spousal support agreement the couple filed in April 2022.

The request is comprised of exhibits that include social media posts of Newman’s wedding to his musician wife Cyn (real name: Cynthia Nabozny) as well as examples of his success as a filmmaker.

In response to King’s filing, Newman claimed in his own filing that the actress had “been out of compliance with the court’s child and spousal support orders for well over a year.”

Newman also alleged that King refused to “sign a judgment” based on their divorce settlement and noted that she cannot “rescind” a court order as she claimed to have done.

King's representatives could not be reached for comment. However, Newman's attorney shared a statement with PEOPLE addressing the latest legal update.

"The day trial in this matter was about to commence, Jaime and Kyle entered into a binding agreement resolving all outstanding issues in their divorce, including child and spousal support," the statement from Garry M. Gekht, Esq. read. "The judge made thorough inquiry of the parties on the record to confirm that the written document accurately reflected their agreement, that they understood its terms and, being satisfied from his inquiry, adopted it as the Court’s order." 

Gekht continued, "The Court saw through Jaime’s latest attempt at attempting to get orders by ambush on an emergency basis, agreed with Kyle’s opposition that Jaime’s request lacks merit, and denied her motion in full today."

King and Newman tied the knot in 2007 at Greystone Park and Manor in Los Angeles. The pair share sons James Knight, 10, and Leo Thames, 8.

The actress filed for divorce from Newman, 48, in May 2020 after 13 years of marriage. At the time, King also filed a domestic violence prevention petition and an emergency motion related to child custody and visitation.

As their divorce progressed, things became messier as King and Newman battled over finances and custody of their children.

According to documents filed in April 2022 and obtained by PEOPLE at the time, King was ordered by a judge to pay Newman $429 per month in child support, plus an additional 16 percent of any income above $175,344 per year, which will be paid quarterly.

Additionally, King was required to pay Newman $1,000 per month in spousal support plus 10 percent of any income above $175,344 per year, which would also be paid quarterly. The payments would continue until either party dies or King gets remarried, per the docs.

The papers also stated that the exes must "meet and confer" every year on January 15 to revisit their agreement and "adjust any overpayments or underpayments" that were made in the previous year.

When it comes to their sons, the former couple was ordered to pay half of any extracurricular activity expenses as well as any unreimbursed medical expenses. They also must communicate with each other if they choose to stop splitting the cost of their children's private school tuition.

The former couple settled their long-disputed divorce in September 2023. Newman's lawyer Garry M. Gekht told PEOPLE at the time: "Kyle and Jaime finally resolved all issues in their divorce yesterday, allowing them to concentrate on being the best parents and co-parents to their two boys. I know that the right thing happened for the children when I see both parents walk out of the courthouse together as friends, sharing a embrace before they part ways."

According to documents filed with the Los Angeles Superior Court of California in September, then obtained by Page Six, the exes' respective attorneys have reached an agreement. The details of the agreement have not been publicly disclosed.

King confirmed the agreement on Instagram at the time, writing, "We have come to a peaceful, loving and harmonious completion of our marriage. As parents loving must prevail."

The statement continued, "The health and well-being of our children has always been our utmost priority. We look forward to co-parenting with grace and understanding. We respectfully ask for privacy for our children and our families at this time."
