This is the Privacy Policy of Norton Optimization Company Inc. dba Excel Panic Button, which applies to the website located at  https://excelpanicbutton.com/ and associated websites, subdomains, mobile versions, applications and services (collectively, the “Services”), which are operated by Norton Optimization Company Inc. (“Company,” “we” or “us”).Company is strongly committed to your right to privacy and to taking steps designed to secure your personal information. The intent of this policy is to fully disclose our privacy practices to you. We will use your information only in accordance with this Privacy Policy. By using the Services, you are accepting and consenting to the practices described in this Privacy Policy, which may be amended in our sole discretion from time to time.  If you use the Services after we have published such changes, you will be agreeing to be bound by those changes.  If you do not agree to be bound by this Privacy Policy at any time, you should not use the Services.

MINORS

Users must be the age of Majority or older (18 in most states of the United States; older in some jurisdictions) to register with us. While individuals under the age of 18 (but not younger than 13) may use the Services, they must do so only with the consent and involvement of a parent or legal guardian, under such person’s account and otherwise subject to our Terms and Conditions. Company does not seek through its Services to gather personal information from or about persons under the age of 13 .  NOTICE: Visit www.OnGuardOnline.gov for tips from the Federal Trade Commission on protecting children’s privacy online. We do not knowingly collect Personal Information from children under the age of 13. If we become aware that we have inadvertently collected such information, we will take reasonable steps to delete it from our records. If you believe that a child under 13 has provided us with Personal Information without appropriate consent, please contact us at support@excelpanicbutton.com.  If such data is found, we will permanently delete it from our active systems and request the same from our third-party processors where applicable.

1.WHAT INFORMATION WE COLLECT ABOUT YOU AND WHY

We may collect two types of information: information by which you may be personally identified, such as your name, email address, and telephone number (“Personal Information”), and information that is about you but individually does not identify you (“Non-Personal Information”). We collect this information directly from you when you provide it to us, or automatically as you navigate through the Services. Please note that we do not sell your Personal Information to anyone.

What Personal Information Do We Collect?

When you use Company’s services. We collect Personal Information such as your name, email address,postal code, billing information, and other information provided to Companywhen you create an account, purchase credits, or subscribe to a membershipplan. We also acquire your Internet Protocol address (“IP address”) and/ormobile device identification, cookies, and related tracking technologies, andwebsite usage details, which certain jurisdictions consider to be PersonalInformation because this information could be used to identify an individual ordevice if combined with other identifying information. This information helpsus to improve our Services and deliver a better and more personalized service.

Support Services. When you contact us for spreadsheet assistance—whether via email, form submission, live call, or chat—we may capture Personal Information related to your request in order to fulfill your service needs and track usage of your credits or membership entitlements. Files or content submitted during support interactions are typically retained for no longer than 6 months, as further described in the “How long we will hold Personal Information” section below.

Customer Service Inquiries. We may capture Personal Information when you send us questions or comments regarding the Services and other inquiries. Information collected in this manner will only be used to contact you and/or respond to your inquiry or issue.

Payment Information. All transactions are facilitated by a third-party payment processor. We do not collect or store financial or billing information and we are not responsible for the collection or storage of such information by third parties.

Third Parties. We may also obtain Personal Information about you through third-party sources such as public databases, social media platforms, or affiliates.

Careers and Internship Opportunities. When you submit your resume or other materials via email, we may keep a record of your contact information and resume. We may use such information to respond to you or consider you for current or future opportunities.

Press and Media. We may capture your Personal Information when you contact us about press inquiries or opportunities to collaborate.

Sensitive Information. We do not request, on or through the Services, other information that is often considered “highly sensitive,” such as financial account information(e.g., credit report data, bank account numbers), or government-issued identification (e.g., social security number, driver’s license, or passport),although we reserve the right to do so if such information becomes necessary to verify your billing or identity.

Security Measures. We take reasonable precautions to protect the confidentiality and security of your Personal Information by using industry-recognized security safeguards such as site monitoring, secured networks and servers, firewalls, and/or encryption. Unfortunately, no method of transmission over the Internet is completely secure. Therefore, while we strive to protect your Personal Information within industry standards, we cannot guarantee its absolute security.

What Non-Personal Information Do We Collect?

Some of the information that we acquire cannot identify, distinguish, or trace you or your device, even if combined with other identifying information, and some information that could be considered Personal Information when combined with other identifying information is not used in a way that identifies, distinguishes, or traces you or your device, but is instead used in an anonymous way, often aggregated with other anonymous information about other users.

To the extent your account closes or becomes inactive, we will continue to protect your information as described in this Privacy Policy.

We may use marketing analytics tools and referral tracking links (e.g., UTM parameters or partner codes) to understand how users find and interact with our Services. This data is not personally identifiable unless voluntarily provided alongside other information.

2. HOW WE USE INFORMATION ABOUT YOU

We may use the Personal Information we collect in the following ways:

To provide our Services. This includes fulfilling support requests made using credits under your membership plan, managing user accounts, tracking credit usage, scheduling live calls, and responding to email support inquiries.

To provide you with updates and relevant information about the Services, offers, promotions, news, events, and other relevant communications. Such direct marketing shall be sent in response to a request from you to receive marketing emails or similar communications. If you would no longer like to receive promotional emails or other communications from us, please refer to the “How you can opt-out from receiving communications from us” section below.

To quickly process your requests for information and to allow us to respond efficiently to user questions and support needs.

To monitor usage patterns and statistical performance in connection with the Services, such as how members use credits or interact with support channels.

To respond to or satisfy legal requirements, such as a court order, a subpoena, or a law enforcement or other public agency request.

To enable access to third-party services (such as scheduling tools or video platforms) if you connect your account or interact with such services through our platform.

To help prevent the instigation of a crime; to help facilitate an investigation related to public safety; to help protect the safety of a user of the Services; to help maintain the security or integrity of the Services; or to enable us to take precautions against liability.

To provide information to vendors or service providers who support our operations and who are contractually prohibited from using your Personal Information for any purpose other than assisting us.

To allow us to disclose your information to the extent permitted or required byapplicable law.

3. HOW YOUR INFORMATION MAY BE SHARED

Except as set forth below, we do not sell, trade, or otherwise transfer to third parties our users’ Personal Information unless we receive their consent. That being said, in the following situations, we may share Personal Information with outside parties:

Partners, Consultants, and Service Providers. We may disclose Personal Information to our partners, third-party consultants, contractors, and service providers to the extent that they require access to our databases, or the information contained in our databases, to perform services on our behalf. These may include customer support platforms, scheduling systems, analytics tools, and communications platforms.

Third-Party Service Providers. Functionalities (called plugins) of different social networks operated by third-party providers (e.g., Facebook, LinkedIn, Google) may be integrated with our Services and allow you to connect your accounts with the Services. Should you connect your social network account(s), Personal Information may be communicated to those third-party providers. Company has no control over the transmission of Personal Information to such third-party providers and assumes no responsibility for their processing of your data. Please review the privacy policies of these providers before connecting any accounts.

Enforcement of Rights / Security. We reserve the right to release Personal Information:
(i) when we are under legal compulsion to do so (e.g., pursuant to subpoena or legal process);
(ii) when we believe it is necessary to protect and/or enforce our rights, property interests, or safety, the safety of our users, or the safety of others; or
(iii) to resolve disputes, troubleshoot problems, prevent fraud, or enforce this Privacy Policy and other agreements.

Reorganization or Sale. In the event that we merge with or are acquired by another organization, sell all or substantially all of our assets, or otherwise undergo a business reorganization, the information you provide may be transferred to the acquiring or reorganized entity.

To Help Protect Minor Users of the Services. In the event that the safety of our users—particularly minors—is threatened, and we are able to mitigate harm by sharing Personal Information with law enforcement or public agencies, we reserve the right to do so.

Aggregated Information. We may aggregate your information with that of other users in such away that it no longer identifies you individually, and we may share this aggregated, non-personal information with third parties for analytics, research, or marketing purposes.

For any other purpose disclosed by us when you provide the information.

With your express consent. We may share your Personal Information with third parties if you haveprovided explicit permission to do so.

Additionally, data obtained through any short code SMS programs will not be shared with third parties for their marketing purposes.

These third-party service providers may include platforms used for calendar scheduling, customer relationship management (CRM), screen recording intake, file storage, email communications, and workflow automation. Each is contractually bound to use your data only as needed to support our Services.

4. HOW WE STORE AND PROCESS INFORMATION ABOUT YOU

The Services are provided in the United States. To communicate with you about offers and support opportunities, the information that we collect from you may be transferred to, stored, used, and processed by the Company in the United States or by one of our service providers, which may also be based in the United States or another jurisdiction. Such entities may be engaged in, among other things:

(i) preparing and sending communications or notifications;

HOWEVER, THEFOREGOING WAIVER MAY NOT BE LEGALLY BINDING IN SOME COUNTRIES, SUCH AS THEMEMBER STATES OF THE EUROPEAN UNION. 5. YOUR RIGHTS UNDER THE GENERAL DATA PROTECTION REGULATION (GDPR)

If you are located in the European Union (EU), European Economic Area (EEA), or United Kingdom (UK), you may have the following rights under applicable data protection laws:

Right to access the personal data we hold about you;

Right to rectification of inaccurate or incomplete data;

Legal Basis for Processing (GDPR)
We process Personal Information under the following lawful bases:

When it is necessary to fulfill a contract or provide requested services

When it is necessary for our legitimate interests (such as operating and improving the Services), and those interests are not overridden by your rights

When we are required to comply with a legal obligation

You have the right to request access to your personal data, including information related to past support interactions, subject to applicable law and authentication requirements. We do not engage in automated decision-making or profiling that produces legal or similarly significant effects on individuals.

6. HOW LONG WE WILL HOLD PERSONAL INFORMATION ABOUT YOU

We will retain Personal Information about you on our systems for as long as is necessary to provide the Services, manage your membership or credit-based account, comply with our legal obligations, resolve disputes, and enforce our agreements.

If you choose to cancel your membership or account, or if your account becomes inactive, we will retain Personal Information only for as long as necessary for administrative, legal, or compliance purposes. Once those purposes are fulfilled, we will delete or anonymize your data, subject to any applicable retention requirements under law.

In the case that you wish to cancel your registration, or otherwise deactivate your account, please contact us at support@excelpanicbutton.com. We will process your request in accordance with this Privacy Policy and applicable laws.

In general, we retain user account data for as long as your membership remains active, and for up to six (6) years after account closure for administrative, audit, and legal purposes, unless a longer retention period is required by law. Data associated with support tickets may be retained for internal reference and service improvement for a similar period.

Files or content submitted during support interactions (such as spreadsheets or screen recordings) are typically retained for no longer than 6 months, unless required for quality assurance, legal compliance, or contractual obligations. Retention periods may vary depending on the nature of the request.

You may request to access, update, correct, or delete your Personal Information at any time. To protect your privacy, we may take reasonable steps to verify your identity before fulfilling such requests. We will respond to verifiable requests within 30to 45 days, depending on the applicable jurisdiction.

7. HOW YOU CAN OPT-OUT FROM RECEIVING COMMUNICATIONS FROM US

If you do not wish to have your information used by the Company to promote our products or Services or to receive other relevant communications, you can opt-out by:

Clicking on the “Unsubscribe” link located at the bottom of any marketing newsletter or promotional email you receive from us, and following the instructions on the resulting page; or

Sending an email stating your request to support@excelpanicbutton.com.

We will endeavor to comply with your request as soon as reasonably practicable. Please note that this opt-out does not apply to communications we may send to you as a result of a credit purchase, membership transaction, or other service-related interactions, including but not limited to account notices, service confirmations, or transactional messages.

8. COOKIES AND OUR ANALYSIS TOOLS

We may use cookies, log files, clear gifs, and/or similar technologies to identify you, track your interactions with the Services, and enhance certain features or functionality. These technologies are small text or electronic files used for user identification, record-keeping purposes, and to improve usability and performance.

We may use both persistent cookies (which remain on your device across sessions) and non-persistent cookies (which are deleted after you close your browser). You can remove or reject persistent cookies by adjusting your browser settings. The Services may contain links to third-party websites or platforms, such as LinkedIn, TikTok, Instagram, YouTube, or other service providers. These third-party websites and platforms do not operate under this Privacy Policy.

We do not exercise control over these external websites and are not responsible for their privacy practices, content, or operations. We recommend that you carefully review the privacy policies posted on any such third-party sites to understand how they may collect, use, and disclose your Personal Information.

Your interactions with these third-party services are governed solely by the terms and policies of those external providers.

11. SMS POLICY

If you opt-in to receive SMS messages from us, please note the following:

You may cancel the SMS service at any time by texting "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you a confirmation message that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you wish to resubscribe, simply sign up again as you did the first time and we will begin sending SMS messages to you again.

If you are experiencing issues with the messaging program, contact us directly at support@excelpanicbutton.com.

Carriers are not liable for delayed or undelivered messages.

Message and data rates may apply for any messages sent to you from us and to us from you. Message frequency may vary depending on your activity. If you have any questions about your text or data plan, it is best to contact your wireless provider.

12. LEGAL DISCLAIMER

We are not responsible for, nor will we be liable to you in any way for, events beyond our direct control with respect to the terms herein. Because of the complex and constantly evolving nature of our technology and business, we cannot guarantee—nor do we represent—that our Services will be error-free or uninterrupted.

To the maximum extent permitted by law, we will not be liable for any direct, indirect, incidental, consequential, or punitive damages or other losses suffered by you relating to the use, misuse, or unauthorized release of your Personal Information, including any loss arising from unauthorized access to your account or data.

We encourage you to take steps to protect your own information, such as maintaining secure login credentials and notifying us promptly of any suspected breach of security.

13. SHINE THE LIGHT LAW

A California privacy law that went into effect on January 1, 2005, the “Shine the Light” law, which allows California residents to obtain a list of third parties to whom a business has disclosed Personal Information if it shares such information with third parties for their direct marketing purposes. However, if a business adopts and discloses in its privacy policy a policy of not disclosing customers’ Personal Information to third parties for their direct marketing purposes unless the customer first affirmatively agrees to the disclosure, the business may comply with the law by notifying the customer of his or her right to prevent disclosure of Personal Information and by providing a cost-free means to exercise that right.

As stated earlier in this Privacy Policy, Personal Information submitted at the time of registration or submission will not be shared with third parties. If our policy changes, Personal Information will only be used for marketing and promotional purposes with your permission; and whenever a user agrees to allow us to collect Personal Information, we provide the user with an option to prevent such information from being shared for marketing and promotional purposes with third parties. Furthermore, you may exercise this cost-free option at any time by sending an email to support@excelpanicbutton.com.  

Because we include a comprehensive privacy policy and provide you with details on how you may opt-in or opt-out of the use of your Personal Information by third parties for direct marketing purposes, we are not required to provide you with the third-party list.

14. YOUR CALIFORNIA PRIVACY RIGHTS (CCPA/CPRA)

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). These rights may include:

We will respond within 45 days, unless additional time is required. We currently accept requests via email only.

California residents may also designate an authorized agent to make requests under this policy. We may require proof of your authorization and identity before processing any request submitted by an agent. We do not discriminate against individuals for exercising their rights under California law.

15. CHANGES TO THIS PRIVACY POLICY

We may update this Privacy Policy from time to time. If material changes are made, we will notify you via email or a prominent notice on our website prior to the change becoming effective. Your continued use of the Services after changes are made constitutes acceptance of those changes.
