Welcome to Cookie Control and Cookie Scanner

This Licence Agreement is provided by Civic Computing Ltd ("CIVIC"). Before using Cookie Control and Cookie Scanner, it's important that you read and understand this agreement thoroughly.

1. Acceptance of Agreement

• Action Required: By clicking "I Agree," you, the "Subscriber," acknowledge that you have fully read, understood, and accept the terms set forth by CIVIC for the use of the Cookie Control and Cookie Scanner products and services.

2. Licence Grant and Restrictions

• Licence Nature: These licences are non-exclusive and non-transferable.
• Community Licence for Cookie Control: Reserved for individual personal use only, with a limit of one free licence per person.
• PRO Licences for Cookie Control: Tailored for business applications, these licences permit the use of Cookie Control PRO across multiple websites, subject to the payment of an annual licence fee.
• Monthly Scan Allowance for Cookie Scanner: Each licence purchased entitles the user to a specific number of cookie scans per month. The monthly period starts on the day of subscription and is refreshed on the first day of each month. Unused scans do not roll over and are forfeited at the end of each month.
• Dependency of Licences: The use of Cookie Scanner requires an active licence for Cookie Control. If the Cookie Control licence expires, the Cookie Scanner licence will no longer be valid. No refund will be issued for the remaining period of the Cookie Scanner licence once the Cookie Control licence has ended.
• Usage Guidelines for Cookie Control: The original icons, name, colour scheme, and link of Cookie Control must not be altered, except by Pro ver-sion users.
• Code Modification for Both Products: Altering the code of Cookie Control or Cookie Scanner is prohibited without prior explicit permission from CIVIC.

3. Subscription Term, Renewal, and Payment

• Duration and Auto-Renewal for Cookie Control: The subscription lasts for 12 months and will automatically renew unless cancellation is requested 30 days before the end of the current term.
• Duration and Auto-Renewal for Cookie Scanner: The subscription lasts for 12 months and will automatically renew unless cancellation is requested 30 days before the end of the current term.
• Fee Structure: Fees for PRO licences of Cookie Control and Cookie Scanner are due annually.

4. Intellectual Property Rights

• Ownership: The names, logos, code, and content of both Cookie Control and Cookie Scanner are the copyright properties of CIVIC.
• Unauthorised Use: Misuse, alteration, or misrepresentation of the intellectual property of either product may result in legal action.

5. Compliance and Liability

• Software Condition: Both Cookie Control and Cookie Scanner are provided on an "as is" basis, without warranties of any kind.
• CIVIC's Liability: CIVIC assumes no liability for legal compliance issues or for browser compatibility, including any limitations stemming from the functionality of both products.
• Geolocation Accuracy: Geolocation is based on IP addresses and is not guaranteed to be exact.
• Compliance Assurance: CIVIC adheres to ISO 27001 standards and GDPR requirements for data handling.

6. Refunds and Cancellation

• Cancellation: To cancel, provide a written notice to info@civicuk.com. The cancellation period for Cookie Control and Cookie Scanner is 30 days.
• Refunds: Issued at CIVIC's discretion, based on individual case assessments.

7. Data Privacy

• Protection of Personal Information: Your privacy is important to us. Your personal information will not be shared with third parties and will be used exclusively for necessary communications regarding both Cookie Control and Cookie Scanner. You may withdraw consent at any time by contacting info@civicuk.com.

8. Limitations of Liability and Governing Law

• Liability Limitation: Liability claims against CIVIC are capped at the lesser of 50% of the fees paid for Cookie Control and Cookie Scanner only in the applicable year or the last billing cycle for the product involved.
• Jurisdiction: This agreement is governed by Scottish law and subject to the jurisdiction of Scottish courts.

9. Disclaimer and Termination Consequences

• Service Availability: Both Cookie Control and Cookie Scanner are provided based on availability, without warranties.
• Termination: Upon termination, all use must cease, and any due payments must be settled.
